Legalization of CBD flowers: HEMP FARM

HANF FARM from Melz calls for the legalization of CBD hemp flowers as a herbal smoke product in Germany. The company has submitted a corresponding application to the Federal Office for Consumer Protection and Food Safety (BVL) for a general order to be issued. The BVL should confirm that CBD flowers are marketable. Rafael Dulon, HANF FARM managing director, appeals in his application to two landmark judgments of the European Court of Justice (ECJ) and the Federal Court of Justice (BGH). The judgment of the BGH of March 24, 2021 in the so-called hemp bar case caused a stir nationwide. It no longer fundamentally excludes the passing on of unprocessed hemp products to end consumers if abuse for intoxication purposes is excluded. As early as November 19, 2020, the ECJ ruled that hemp extracts and the CBD they contain are not narcotic drugs.

“When evaluating our application, the BVL must take these two highest judicial decisions into account, particularly in connection with the free movement of goods within the European Union,” said Rafael Dulon. “In Belgium, Luxembourg and Austria, CBD flowers are freely marketable – so why not in Germany too.”

According to the lawyers Kai-Friedrich Niermann (KFN + Law Office) and Michael Lito Schulte (, high-priced CBD flowers in small sales quantities are herbal smoke products that must be regulated according to the Tobacco Product Directive. The Tobacco Products Act offers the possibility to apply to the BVL for a general decree. This is exactly the application that Niermann and Schulte have now submitted for the HEMP FARM.

HEMP FARM plans to import industrial hemp flowers as a herbal smoke product from the Belgian company Buddy. The tobacco substitute ARTUR made from pure flowers is produced by the Swiss company The Botanicals.

“If the BVL’s test turns out positive – and I firmly assume – we will be able to legally sell CBD flowers as a tobacco substitute in Germany in the future without constantly feeling criminal prosecution,” says hemp farmer Rafael Dulon happily.

The entrepreneur Rafael Dulon has been active in the cultivation of industrial hemp and the marketing of industrial hemp products for 25 years and heads HANF FARM GmbH in the Mecklenburg Lake District. At present, industrial hemp is grown and harvested on up to 1,000 hectares. This makes HANF FARM one of the largest producers of German industrial hemp.
